Industrial hemp is rapidly becoming one of the UK’s most talked-about "break crops." Favoured for its carbon-sequestering abilities and its use in everything from sustainable textiles to "hempcrete" construction, it offers a unique economic opportunity for the agricultural sector.
However, because hemp is a variety of the cannabis plant, it remains a controlled substance. To grow it legally, you must navigate a strict Home Office licensing regime. Following significant policy updates for the 2025 and 2026 growing seasons, here is what you need to know to stay compliant.
The most important takeaway from the official GOV.UK guidance is the intended end-use. An industrial hemp license is only granted for the harvest of seeds and fibre (stalks).
While the "green" parts of the plant—the leaves and flowers—contain CBD, they are considered controlled drug material. Under this specific license, these parts must be destroyed on-site. If your goal is to extract CBD from the flowers, you cannot use an industrial hemp license; you would instead require a standard cannabis cultivation license, which involves much higher security requirements and fees.
The government recently introduced reforms designed to cut "red tape" and help the industry flourish. Key changes include:
Whole-Farm Flexibility (Active 2025): Previously, farmers had to specify the exact field for cultivation. Now, once licensed, you can grow hemp anywhere within the extent of your licensed farm, allowing for better crop rotation.
6-Year Licenses (Active 2026): To provide long-term security for investment, the maximum duration of a license has been doubled from three years to six years.
Deferred Start Dates: New applicants can now defer the start of their license by up to one year, giving more breathing room for business planning and infrastructure setup.
To qualify for the "light touch" industrial hemp regime, the crop must be grown from approved seed varieties with a THC content not exceeding 0.2%. (Note: While there are recommendations to raise this to 0.3%, the current legal limit remains 0.2% until stated otherwise).

DBS Check: All applicants must undergo an Enhanced DBS check through the Home Office's approved provider (Security Watchdog).
The application window opens January to March. Allow upto 6 weeks for processing before the spring sowing season, so apply early! You must apply online via the Home Office’s iCasework portal. You will need to provide grid references for your land, a "Sensitive Location Statement" (ensuring the crop isn't near schools or public rights of way), and proof of your seed's THC credentials.
